The Fray Bartolomé de Las Casas Human Rights Centre (Frayba,) has information on the serious situation of threats and attacks by the “Pojcol Group” against the Support Bases of the Zapatista Army of National Liberation (BAEZLN) in the Community of El Rosario, Rebel Zapatista Autonomous Municipality (MAREZ) San Manuel; and threats against the community of Nuevo Paraíso, in the official municipality of Ocosingo, Chiapas, who belong to the Good Government Junta “The Path to the Future,” Caracol III, La Garrucha.

On 12th February, 2015, this Centre for Human Rights documented the destruction of a piece of land belonging to a BAEZLN in the community of El Rosario, and the tense situation that has existed for about 3 weeks due to the incursions of armed people from Pojcol, in the municipality of Chilón, Chiapas, who have fired gunshots into the air during the night.

According to the testimonies, the aggressor group has the collaboration of people from Guadalupe Victoria and El Rosario, who are facilitating the acts of aggression, threats and harassment against the BAEZLN.

On 22nd February, 2015, Frayba received information regarding two letters signed by a “representative of Pojcol group”, which warn and give a deadline to the BAEZLN: “[…] that they must withdraw the Zapatista guard from that place (El Rosario) or else we will take Nuevo Paraíso […] ” “To Avoid further bloodshed […] “

The acts of aggression and threats made by the “group from Pojcol” violate the right to autonomy and self-determination, as well as endangering the life, safety and physical integrity of the BAEZLN community of El Rosario and Nuevo Paraíso. These rights are enshrined in the Mexican Constitution and Convention 169 of the International Labour Organization (ILO), the United Nations Declaration on the Rights of Indigenous Peoples, as well as the San Andrés Accords.

This Human Rights Centre has been informing the government of Chiapas about the situation of risk that exists in el Rosario since July 2014, but to date they have taken no effective measures to resolve the conflict.

Therefore, this Centre for Human Rights demands from the Mexican government:

  • That the autonomy of the Zapatista Peoples is respected, particularly of the communities of El Rosario and Nuevo Paraíso.
  • That the necessary measures are adopted to safeguard the lives and integrity of the people living in the communities of El Rosario and Nuevo Paraíso, preventing the conflict from escalating.
  • That the necessary measures are effectively implemented to stop the violence against the BAEZLN.
  • That they investigate and punish the offenders of the self-identified group Pojcol, which since July 2014 has harassed and assaulted the BAEZLN and residents of the region.

Background:

On Friday 25th July 2014, 19 armed persons entered the land for regional collective work of the MAREZ of San Manuel, leaving a sign which read: “territory of Pojcol” and threatening the Autonomous Communities of El Rosario and Egypto that they would dispossess them of their lands; later, on 1st August people from the ejido Pojcol forcibly displaced 32 people from the community of Egipto. 1

On 6th August, 2014, 15 people from Pojcol entered the lands of the BAEZLN from the MAREZ previously referred to, where they felled trees and fired shots into the air. The same day, they also fired shots into the air in communities of El Rosario and Kexil. Due to these facts, the Centre for Human Rights issued an Urgent Action on 7th August, 2014 and updated it on 15th August of that year. 2

URGENT ACTION

SUMMARY

On February 2, 2011, the Mexican government took possession, through the use of public force, of an area of common land of the ejido San Sebastián Bachajón, which is crossed by a road leading to the Ecotourism Centre “Agua Azul Waterfalls” located in the neighbouring settlement of Agua Azul, municipality of Tumbalá, Chiapas, Mexico; a tourist destination with worldwide recognition, which is part of a megaproject which the Mexican government intends to implement, called the “Palenque Integrally Planned Centre” (CIPP). In this area of the ejido the ejidatarios, adherents to the Sixth Declaration, had installed a tollbooth, an office for meetings, and public toilets. The Mexican government carried out a violent eviction, and, without consultation and free, prior and informed consent, took over the ownership and administration of the dispossessed land, which was controlled by various police forces until the early hours of December 21, 2014 when it was regained by the ejidal organization.

The ejido Commissioner at the time, Francisco Guzmán Jiménez, worked with the government to hand over the land, and now his successor Alejandro Moreno Gómez and the Vigilance Councillor Samuel Díaz Guzmán maintain the same collaborationist posture with the Mexican government without taking into account the will of their people, and they intend hand over our lands once again to the federal and state governments.

FACTS

On December 21, 2014, at about 6 am, over 300 men, women and children from the three regions that make up the ejido San Sebastián Bachajón, recovered peacefully the lands located in the area of ​endowment of the ejido, in the official municipality of Chilon, Chiapas, which borders the municipality of Tumbalá and the village of Agua Azul. These lands are crossed by the access road to the Ecotourism Centre of the “Agua Azul Waterfalls,” which is recognized as a tourist destination worldwide.

The recuperation of the dispossessed land is the result of an agreement between the ejidatarios of the three annexes that make up the ejido San Sebastián Bachajón: Bachajón, Alan Sacjun and Ch’ich; arising from the fact that the Mexican government, about three years ago, through the CONANP, IPC and SSyPC, appropriated that area without permission and/or authorisation from the ejido, and without observing the right to consultation and free, prior and informed consent.

According to the information we received, we have a well-grounded fear that in the coming hours the ejido authorities will act violently to evict the women, men and children who are protecting the reclaimed lands. Furthermore, Mexican government officials have indicated to the ejidatarios that, within the same period of time, public forces will be sent to displace them. Disregarding the fact that the organization has said it is willing to dialogue and seek a solution by peaceful means, the government and the ejido representatives are choosing the path of repression.

BACKGROUND

On February 3, 2011, 117 compañeros from San Sebastián Bachajón, adherents to the Sixth, were arbitrarily deprived of their liberty as a means to dissolve our organization in resistance and as a means of pressure to accept the handing over of land to government control; nevertheless, five months later they were released in full, thanks to national and international solidarity. In August and September 2011 respectively, Antonio Estrada Estrada and Miguel Vazquez Deara, for being active members of the organization and adherents to the Sixth, were arrested and tortured to incriminate themselves of criminal acts. Both compañeros gained their freedom through the struggle of the organization.

In March 2011 our organization filed an amparo, 274/2011, with the Seventh District Judge in Tuxtla Gutierrez, Chiapas, against the dispossession.

On 24th April, 2013, our compañero Juan Vázquez Guzmán, adherent to the Sixth, spokesman for the organization, community leader and human rights defender was murdered with gunshots. For his activism in the defence of the lands of his people he was illegally detained on 24th December, 2011 and on March 22, 2012 he was threatened with death by the then officialist ejidal commissioner of San Sebastián Bachajón, Francisco Jiménez Guzmán.

In the morning of 21st March, 2014, the compañero Juan Carlos Gómez Silvano, coordinator of our organization for the defence of the land, was killed with over twenty high calibre gun shots.

On 16th September, 2014, compañeros Juan Antonio Gómez Silvano, Mario Aguilar Silvano and Roberto Gómez Hernández were illegally detained and tortured; they are still being held in prison in Yajalón for crimes they did not commit; the municipal police of Chilón, Chiapas are part of the arrest and accusation; they themselves fabricated evidence against our compañeros.

APPEALS

  1. That the life and personal integrity of the women, men and children who protect the lands recovered on 21st December 21, 2014, is guaranteed.
  2. That priority is given to dialogue and that all acts of repression are avoided against our compañeros and compañeras who are struggling for and defending our rights.
  3. That our autonomy and self-determination as indigenous peoples is respected according to Article 2 of the Political Constitution of the United Mexican States, Convention 169 of the International Labour Organization, and the Accords of San Andrés Sakam Chem de los Pobres.

The day after they reclaimed their lands, there is information that the ejido commissioner of San Sebastián Bachajón, Alejandro Moreno Gómez, and the vigilance councillor, Samuel Díaz Guzmán, have been requesting the entry of the police (public forces) and armed groups are currently being organized, led by Juan Alvaro Moreno from the village of Xanil, Manuel Jiménez Moreno from the village of Pamalá and Carmen Aguilar Gómez from the village of Chewal Nazaret; the aim is to evict with violence the ejidatarios of San Sebastián Bachajón  in the next few hours. There is a serious risk that children, the elderly and young people who are on reclaimed land will suffer attacks on their lives and personal integrity. Full solidarity and support is requested.

Threats of displacement and aggression against Tojolabal families, supporters of the EZLN

This Centre for Human Rights has received reliable documentary information about threats of displacement and aggression towards families from the Primero de Agosto community who are supporters of the Zapatista Army of National Liberation (EZLN); the actions were committed by members of the Independent Central of Agricultural workers and Campesinos – Historical (CIOAC-H), who are protected in the region by the municipal government of Las Margaritas.

According to information, today, December 17, 2014, at approximately 6 am, 50 people, members of the CIOAC-H from the ejido Miguel Hidalgo, entered the community of Primero de Agosto, all armed with sticks and machetes and some of them carrying guns.

The situation of violence is critical because a group of people from CIOAC-H are attacking the families of EZLN supporters, they have thrown down the fencing where the animals are penned, and are destroying the houses.

This Human Rights Centre URGENTLY demands that the federal and state governments:

First: Urgently protect the life and physical integrity of the families of EZLN supporters from Primero de Agosto community

Second: Prevent the forced displacement of the families of EZLN supporters, respecting and guaranteeing the rights enshrined in international declarations and conventions relating to the autonomy and self-determination of indigenous peoples.

Third: Punish those members of the CIOAC-H who are destroying property and assaulting the families of the community of Primero de Agosto.

 

Background 

17 Tojolabal families, in need of work and access to land, took possession of a piece of unused land called “predio el Roble”, which was not occupied, nor does it belong to the ejido Miguel Hidalgo. These lands were recovered in 1994 by the EZLN.

Families of Primero de Agosto have been attacked and threatened by the ejidatarios of Miguel Hidalgo, since they took possession of the land in 2013.

The Centre for Human Rights has made representations to the authorities of the municipality of Las Margaritas, from the beginning of the conflict, through oficio 052-004-13/EAI-115/2013. However the situation of violence in the area has escalated, to the extent that on May 9, 2014, Arturo Pérez López was wounded in the neck with a machete by Aureliano Méndez Jiménez, Secretary of the Supervisory Board of Miguel Hidalgo and member of the CIOAC-H, but up to now the authorities have not acted in regard to this.

Finally we ask national and international civil society to respond in solidarity by sharing information about the actions reported, and by signing and sending this urgent appeal to the authorities listed here.

The Fray Bartolome de Las Casas Human Rights Centre (Frayba) has documented death threats, harassment with firearms and aggressions against support bases of the Zapatista Army of National Liberation (BAEZLN) from the Autonomous Communities El Rosario and Kexil in the Rebel Zapatista Autonomous Municipality (MAREZ) of San Manuel (official municipality of Ocosingo), belonging to the Good Government Council (JBG) “The Way of the Future”, Caracol III, La Garrucha, Selva Tzeltal Zone, Chiapas.

On Monday, 4th August, in the Autonomous Community of El Rosario, at 6 am, a horse of a BAEZLN was killed by wound in the abdomen. The same day, another BAEZLN went to get his firewood and on the way he met Enrique Sánchez Martínez, from the El Rosario community and a member of the Regional Organization of Autonomous Coffee Growers of Ocosingo (ORCAO), who said to him: “Take care of yourself; I am going to kill you.”

On August 6, at 7.30 am, two Nissan vehicles arrived from the direction of Pojcol, municipality of Chilón, at the Autonomous Community of El Rosario, with people who were carrying guns, and bringing a chainsaw, who went to the land for regional collective work of the Autonomous Municipality of San Manuel, where 15 people remained behind. The Nissan pickup trucks returned toward the ejido Pojcol; when leaving the Autonomous Community of El Rosario the drivers were detained briefly by members of the ORCAO with whom they had a talk and then continued on their way.

At 9.15 am, the 15 people who were in the land for regional collective work of the Autonomous Municipality of San Manuel, began cutting trees and fired several shots into the air. At 10.40 am they began to gather the wood which had been cut.

Later, at 2.18 pm, the two Nissan trucks returned to the Autonomous Community of El Rosario, the 15 people got off, and going through the house of a BAEZLN fired ​​five shots. At 2.51 pm while crossing the community of Kexil they fired two shots above the roof of the home of a BAEZLN of that community. The trucks continued toward the ejido Pojcol.

In view of this situation, Frayba expresses its concern about the threat to the life, integrity and personal security faced by the BAEZLN communities of El Rosario, Kexil and Egipto in the Municipality of San Manuel, as the threats and harassment have increased in recent days, including the shooting of firearms.

This Human Rights Centre states:

The responsibility of the state through omission, since government authorities have not acted to ensure the integrity and personal safety of the BAEZLN in spite of the requests for  intervention which we have made.

And it demands:

An end to the death threats, harassment, assaults, damage and attempted dispossession against the BAEZLN;

Protect and guarantee the life, integrity and personal safety of the BAEZLN in respect of their process of autonomy which they are constructing under the right to self-determination of the peoples, referred to in the San Andrés Accords, and established in international treaties such as Convention 169 on Indigenous and Tribal Peoples in Independent Countries and the United Nations Declaration on the Rights of Indigenous Peoples.

Finally we call on national and international solidarity to show its support to threatened BAEZLN.

Background

On 1st August, at 11.30 pm, a group of armed people from the ejido Pojcol went into the land used for regional collective work of the Autonomous Municipality of San Manuel, recovered by the Zapatista Army of National Liberation (EZLN). In this territory, adjacent to the Autonomous Communities of El Rosario and Egipto, the armed people killed a young bull and gunshots were fired. While the group from Ejido Pojcol were carrying out acts of occupation and armed harassment, members of the Egipto Autonomous Community realised that several individuals, with lamps in their hands, were heading towards their village. For this reason, and to avoid a possible attack, on 2nd August, at 12.30 am, 32 people (women, children, and old people) were forcibly displaced, walking throughout the early hours of the morning to reach another Zapatista village where they are currently taking refuge.
